Congressmen Propose Bill to Abolish OSHA

Several constitutionalist congressmen have introduced legislation to abolish the Occupational Safety and Hazard Administration (OSHA), an unconstitutional federal agency that has seriously infringed upon Americans’ individual, God-given freedoms.

H.R. 5813, titled the “Nullify Occupational Safety and Health Administration Act” or the “NOSHA Act,” is sponsored by U.S. Representative Andy Biggs (R-Ariz.) and cosponsored by seven other representatives. It is currently pending in the U.S. House Committee on Education and Labor.

H.R. 5813 is a simple bill, with the bill text being short and concise. If enacted, it would repeal the Occupational Safety and Health Act of 1970, which created OSHA, and abolish the federal agency.

OSHA was the agency tasked with implementing and enforcing Joe Biden’s executive order mandating that employers with over 100 employees force them to get the COVID vaccine. Although the U.S. Supreme Court blocked the mandate earlier this month, the federal agency was dutifully carrying out Biden’s unconstitutional order, was making plans to use whistleblowers to help enforce it, and was even considering expanding the mandate to also cover small businesses.

In an interview with The New American magazine, Representative Thomas Massie (R-Ky.), one of H.R. 5813’s cosponsors, noted OSHA’s blatant disregard for the U.S. Constitution and for individual freedom:

One of the most troubling things about Biden’s … unconstitutional vaccine mandates that have been stopped by the courts is that the agencies who were tasked with enforcing them did not even question the fact that they were illegal. He told them to do something that was illegal they carried it out, and they carried it out until the courts stopped them.

It’s almost Orwellian. The very agency that’s supposed to protect you from your employer doing something to you that you don’t want is forcing you to have your employer do something to you that you don’t want.

Under the U.S. Constitution, there is no basis for OSHA’s existence. Article I, Section 8, does not give Congress any authority to regulate workplaces. Furthermore, the 10th Amendment makes clear that all powers not delegated to the federal government are reserved to the states or the people. Representative Biggs alluded to this fact when he noted, “OSHA’s existence is yet another example of the federal government creating agencies to address issues that are more appropriately handled by state governments and private employers.”

Not only is OSHA illegal, but it is part of the Deep State’s plan to abolish individual freedom in the United States. As Alan Stang wrote in American Opinion in October 1975:

Some businessmen have told your reporter of their fear that if they speak up, O.S.H.A. may close them down. The answer to that is: You have said nothing so far, and you are already almost out on the street. If you continue to do and say nothing, you will wind up crushing rock for the government, where the ‘protection’ of O.S.H.A. will not apply. Before it is too late, you must realize that O.S.H.A. is not a labor-management disagreement. It is part of a Conspiracy by the Socialists who run our government to shut you down and take over. You have nothing to lose and everything to gain, if you stand and fight.

Accordingly, it is imperative that patriots stand up against this illegal and unaccountable agency. Not only should state legislatures nullify OSHA — they have authority under the Constitution to do this — but Congress would be wise to enact H.R. 5813 to abolish it outright, in addition to abolishing every other unconstitutional federal agency or action. By “simply say[ing] no” to the increasingly tyrannical government mandates, Americans can preserve and restore the God-given freedoms that the Constitution guarantees.
